1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the virtual private server (VPS), game server hosting, and related services (“Services”) provided by AK Arctic Hosting (“Company,” “we,” “us,” or “our”), a company headquartered in the State of Alaska, United States.

By accessing or using our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. Eligibility and Registration

  • You must be at least eighteen (18) years of age to use our Services.
  • You agree to provide accurate, current, and complete registration information.

3. Service Description

AK Arctic Hosting provides VPS hosting, game server hosting, and related infrastructure services on an “as is” and “as available” basis. We do not guarantee uninterrupted service or uptime.

4. Acceptable Use Policy

You may not use our Services to:

  • Engage in illegal activity or violate applicable laws
  • Host malware, exploits, phishing content, or malicious software
  • Perform or participate in DDoS or other network attacks
  • Send spam or unsolicited bulk communications
  • Infringe intellectual property rights
  • Consume excessive system or network resources

5. DMCA & Copyright Compliance

AK Arctic Hosting complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). We will respond to valid DMCA takedown notices and may suspend or terminate repeat infringers.

6. Content Responsibility

You are solely responsible for all content, data, and software hosted on your services. AK Arctic Hosting does not monitor customer content and assumes no liability for user-hosted material.

7. Billing and Payments

  • Services are billed in advance on a recurring basis
  • All payments are non-refundable unless stated otherwise
  • Failure to pay may result in suspension or termination

8. Suspension and Termination

We reserve the right to suspend or terminate services immediately for violations of these Terms, abuse, or illegal activity. Upon termination, hosted data may be permanently deleted.

9. Backups and Data Loss

AK Arctic Hosting does not guarantee backups. You are responsible for maintaining your own backups.

10. Limitation of Liability

To the maximum extent permitted by law, AK Arctic Hosting shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by you in the thirty (30) days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AK Arctic Hosting from any claims, damages, or expenses arising from your use of the Services.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Alaska and the United States. Any disputes shall be resolved exclusively in Alaska courts.
